IHC Orders End to Imran Khan, Bushra Bibi’s Solitary Confinement; Allows Family Meetings and Phone Calls

Justice Khadim Hussain Soomro cites Nusrat Bhutto precedent; Adiala Jail authorities ordered to submit compliance report within 15 days

The Islamabad High Court (IHC) on Tuesday ordered an end to the solitary confinement of former Pakistan prime minister and Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife, Bushra Bibi, directing Adiala Jail authorities to provide them with facilities and privileges available under prison rules.
Justice Khadim Hussain Soomro announced the reserved verdict while ruling that the petitions challenging the isolation of Imran Khan and Bushra Bibi were maintainable.
The court directed the Adiala Jail administration to ensure that neither Imran Khan nor Bushra Bibi is kept in isolation in a manner inconsistent with applicable prison regulations.

Newspapers, Books and Medical Facilities

Under the court’s directions, the incarcerated couple must be provided with facilities permitted under jail rules, including access to newspapers and books as well as standard medical care.
The court also ordered prison authorities to ensure that rules governing meetings with family members and relatives are properly followed.

Imran Khan Allowed to Speak With His Sons

In another significant direction, the court allowed Imran Khan to make telephone calls to his sons.
However, the court attached a condition to the facility, stating that it may be withdrawn if recordings of the conversations are subsequently used for political propaganda.

Court Refers to Previous Cases

Justice Soomro referred to legal precedents, including the Nusrat Bhutto case and the Begum Shameem Afridi case, while issuing the ruling.

The judgment makes clear that prison authorities must deal with Imran Khan and Bushra Bibi in accordance with the applicable jail rules and cannot subject them to isolation contrary to those regulations.

Petitions Challenged Isolation in Adiala Jail

The petitions were filed separately on behalf of Imran Khan and Bushra Bibi.
Aleema Khan challenged the conditions under which Imran Khan was being held, while Mubashara Khawar Manika filed the petition concerning Bushra Bibi’s solitary confinement.
The Islamabad High Court had reserved its decision in the matter on August 6.
The court has now directed Adiala Jail authorities to implement its orders and submit a compliance report within 15 days.
