A Takanini early childhood teacher has been formally censured and placed under conditions on her practising certificate after a disciplinary tribunal ruled that slapping a four-year-old child amounted to serious misconduct.
The ruling relates to Shifali Arora, who was working at Lollipops Takanini when the incident happened in July 2020.
The Teachers Disciplinary Tribunal said physical violence against a child was fundamentally inconsistent with a teacher’s responsibility to protect those in their care.
Tribunal chair Theo Baker said teachers are trusted not only to educate children but also to ensure their safety, adding that hitting a student was a clear breach of that responsibility.
The incident occurred while children from the centre’s “over twos” group were being moved indoors.
A four-year-old boy ran into Arora and struck her stomach. The tribunal heard Arora had undergone a medical procedure the previous day and the impact caused significant pain.
She reacted by striking the child across the face.
The boy was left distressed, crying loudly and holding his cheek, which had become red.
Arora later described her reaction as a brief loss of control. She accepted that her conduct amounted to serious misconduct and told the tribunal she had undertaken counselling following the incident.
The episode also had immediate employment consequences. Arora lost her position at the centre, which was operated by Evolve Education Group, and Police were informed. She was subsequently given a formal warning.
The disciplinary decision itself was made in 2022 but has only now been released publicly.
As part of the tribunal’s orders, Arora was required to complete the Incredible Years Programme and, for 18 months, disclose the tribunal decision to any prospective employer.
She was also ordered to pay $1602 in costs.
The tribunal made clear that personal pain or an unexpected physical reaction from a child did not excuse the use of force by a teacher.
